The Economic and Financial Crimes Commission, or EFCC, is prohibited from apprehending, holding, and prosecuting former Kogi State governor Yahaya Bello, according to a two-hour ruling issued by a High Court in Lokoja on Wednesday.
According to Justice I.A. Jamil, violating the former governor’s rights is unacceptable unless the court specifically orders it to do so.
“By this order, the EFCC is hereby restrained from arresting, detaining and prosecuting the applicant. This is a definite order following the earlier interim injunction given.”
The order followed Bello’s case of a breach of his fundamental human rights by the anti-graft agency before the state high court.
The former governor had prayed for an order restraining EFCC from unjustly arresting, detaining, and prosecuting him.
The court ruled that the substantive issues of fundamental human rights sought by the applicant succeeded.
