The Court of Appeal in Abuja has dismissed an appeal by Assistant Commissioner of Police, Sunday Ubua, seeking bail.

Ubua is a friend of suspended  Abba Kyari, a deputy commissioner of police.

Ubua is being prosecuted for drug-related offences by the National Drug Law Enforcement Agency.

On Friday, a three-member panel of the appellate court ruled that Ubua’s appeal was without substance and upheld Judge Nwite’s order from March 28, 2022.

The court denied Ubua’s bail application on March 28 because the prosecution provided sufficient evidence to justify its denial.

In the lead opinion, Judge Stephen Adah affirmed that the appellant should have given new evidence to the court to justify the court’s departure from the earlier decision by Justice Emeka Nwite of the Federal High Court of Nigeria, Abuja.

Ubua is standing trial alongside Kyari and three other former members of the Nigeria Police Force special squad on charges bordering on unlawful drug dealing and attempting to tamper with evidence.
